1. Introduction
These Terms of Service ("Terms") govern your use of the Adaptive Fitness website and your purchase of the SGEP Fitness Assessment ("the Assessment") and any related services we offer. By placing an order or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our website or purchase our Assessment.
2. About Us

3. Eligibility
By purchasing the Assessment, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.
4. Our Product
The SGEP Fitness Assessment is a Level 1 online assessment based on the full Scrum Guide Expansion Pack. It consists of 70 questions to be completed within 40 minutes, with a pass mark of 90%. Successful candidates receive a digital badge valid for 12 months from the date of issue. To maintain the badge beyond 12 months, you must retake and pass the Assessment afresh. The Assessment is delivered through the ClassMarker test engine. A free Open Assessment (30 questions in 20 minutes) is also available as preparation.
5. Orders and Payment
All orders are one-time purchases made through our website. Prices are displayed at checkout and will include taxes, where applicable. Payment is taken in full at the time of purchase. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or unavailability.
A contract between you and Orderly Disruption is formed when we send you confirmation that your order has been accepted.
6. Delivery and Access
Access details for the Assessment will be sent to the email address you provide at checkout, typically within a few minutes of purchase. It is your responsibility to provide a valid email address and to check your spam or junk folder if you do not receive your confirmation. If you have not received access within 24 hours, please contact us.
7. Right to Cancel and Refunds
Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you ordinarily have a 14-day right to cancel a purchase of digital content. However, by starting or attempting the Assessment, you expressly acknowledge that you lose this right to cancel. Nothing in these Terms affects your statutory rights as a consumer.
8. Intellectual Property
All content related to the Assessment, including but not limited to questions, answers, branding, badges, written materials, webinars, and the Scrum Guide Expansion Pack, is owned by Orderly Disruption or its licensors and is protected by UK and international copyright law.
You are granted a limited, personal, non-transferable, non-exclusive licence to access and use the Assessment for your own personal or professional development. You must not copy, reproduce, distribute, publish, screenshot, share, resell, or otherwise make available any part of the Assessment or its contents to any third party. Any such conduct may result in revocation of your badge and may give rise to legal action.
9. Badges and Certification
If you achieve a passing score of 90% or higher, you will be awarded a digital badge valid for 12 months from the date of issue. The badge is personal to you and must not be transferred, sold, or misrepresented. Orderly Disruption reserves the right to revoke a badge at any time if we have reasonable grounds to believe it was obtained through cheating, misuse, sharing of credentials, or breach of these Terms.
A passing score does not entitle you to any professional certification, accreditation, or qualification beyond the badge itself, nor does it imply employment, endorsement, or affiliation with Orderly Disruption.
10. Webinars and Community Conduct
If you participate in any webinars, updates, or community channels offered by Orderly Disruption, you agree to behave respectfully and lawfully. We do not tolerate harassment, hate speech, spam, sharing of assessment content, or any unlawful conduct. We reserve the right to remove participants and to refuse future access to anyone who breaches these standards, without refund.
11. Acceptable Use
You agree not to: (a) use the Assessment or our website for any unlawful purpose; (b) attempt to gain unauthorised access to any system, network, or account; (c) interfere with or disrupt the operation of our website or the Assessment; (d) use bots, scrapers, or automated tools to access content; (e) impersonate another person or misrepresent your identity; or (f) share, publish, or distribute Assessment questions or answers in any form.
12. Disclaimers
The Assessment and our website are provided on an "as is" and "as available" basis. While we take reasonable care to ensure accuracy and availability, we do not warrant that the Assessment will be uninterrupted, error-free, or that it will meet any specific outcome you may expect. Reliance on any information obtained through the Assessment is at your own risk.
13. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law.
Subject to the above, our total liability to you in connection with these Terms or your use of the Assessment is limited to the amount you paid for the Assessment. We will not be liable for any indirect, consequential, or special losses, including loss of profit, loss of business, loss of opportunity, or loss of data.
14. Indemnification
You agree to indemnify and hold Orderly Disruption harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Assessment, or your violation of any third party's rights.
15. Termination
We may suspend or end your access to the Assessment or our services at any time if you breach these Terms, and we may revoke any badge issued in connection with such a breach. Termination does not entitle you to a refund except where required by law or under our Refund Policy.
16. Changes to These Terms
We may update these Terms from time to time. The version in force at the time of your purchase will govern that order. Any updated version will be posted on our website with a revised "last updated" date.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer resident in another part of the UK, in which case the courts of your home jurisdiction may also have jurisdiction.
